Welcome to Oggangs,

These Terms & Conditions (hereinafter referred to as the “Terms” or “Terms of Use”) shall govern the relationship between Oggangs Private Limited, a private limited company, incorporated under the provisions of Companies Act, 2013, and having it’s registered office at Bangalore, Karnataka (IN) (hereinafter referred to the “Company” or “Oggangs” or “us” or “our” or “we”) and you (hereinafter referred to “you” or “your” or “user(s)” or “player(s)”) and shall also govern your use of www.oggangs.com/ and its related mobile application, namely, “OGGANGS” available on Apple’s App Store,  (hereinafter referred to as the “Website” or “Site” or “App” or “Platform”).

These Terms are published in accordance with Rule 3(1) of Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This document has been made in full compliance with Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and Consumer Protection (E-commerce Rules), 2020. This electronic record is generated by a computer system and does not require any physical or digital signatures.

We are an esports, pc, console gaming hosting App. Our App allows you to participate in esports and gaming events, and win rewards and vouchers (“Services”). Additionally, how we collect, use, store, share and transmit your data is governed by our Privacy Policy statement. These Terms & Conditions shall be read in conjunction with our Disclaimer and Privacy Policy statement.

Oggangs is not associated or in affiliation in any manner with any esportsgoverning leagues or authorities. Please read these terms carefully. If you do not accept these Terms in its entirety, then you cannot use the site or App or avail our services.

 

ACCEPTANCE OF THE TERMS & CONDITIONS

By downloading or accessing or using our App or Website or participating in esports events or games on our App, or by clicking on a button or taking similar action to signify your affirmative acceptance of these Terms, you hereby represent that:

• You have read, understood, and agreed to be bound by these Terms, any future updates and additions to these Terms, as published from time to time at the Website and App.
• You are residing in India, are of sound mind and at least 18 years in age as per the laws of Republic of India, in order to form a binding contract with us. 
• You have read, understood and consented to our Disclaimer and Privacy Policy statement.
• We have not previously disabled your account for the violation of law or any of our policies.
• You must not be prohibited under the Indian laws from accessing or using our services due to any reason, including without limitation, a court’s judgment.

 

ACCOUNTS, PASSWORDS AND SECURITY

• Account Registration: To access various parts of the App, and to avail various services of Oggangs (for example, participating in esports events and games), you might be required to register and create an account with us. When setting up and maintaining your account, you must provide and continue to provide current, accurate and complete information about yourself. As part of the registration process, you will create a password and an account. 
• Security: You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your account, including, without limitation, all actions by sub-users registered under your account. You agree to (a) immediately notify us of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. We cannot and will not be liable for any loss, damage or other liability arising from your failure to comply with this Section or from any unauthorized access to or use of your account.
• Inaccurate Information: If we have reasonable grounds to suspect that any of the information submitted by you is untrue, inaccurate, outdated, or incomplete, we may terminate your account and refuse current or future use of any or all of the services. In such cases, you will not be entitled to be compensated or refunded for the ruby and sapphire in your wallet. 

 

• Ruby

“Ruby” refers to the currency that you can convert or earn on Oggangs. Ruby is a virtual currency or virtual money. The Ruby you convert, win or lose have no value in real money, and these can never be withdrawn for real money. This virtual currency does not refer to any credit balance of real currency or its equivalent. You cannot withdraw your Ruby, and are only entitled to use it to participate in events, win vouchers and rewards, as per event rules, as may be amended by us from time to time. (1000 Rubies can be converted into 1 Sapphire)

 

• Sapphire

“Sapphire” refers to the currency that you can purchase or earn on Oggangs. Sapphire is a virtual currency or virtual money to use them partially in in-app purchases. You can withdraw your Sapphire below 300 INR every week, and are also entitled to use it for discounts on in-app purchases, as may be amended by us from time to time. (1 Sapphire is equal to 1 Rupee)

 

USE OF THE OGGANGS APP AND SITE

Allowed uses:

• Directions of Use: You must follow any and all guidelines or policies or directions of use as associated with our services, including all the features and functionalities of our App, esports events and games.
• Information: Whenever prompted, you must provide us with the correct, accurate and updated information about yourself. We will process this information as per our Privacy Policy statement as available on our App and Site. 
• Single Account: You, as a single user are permitted to register or operate only one user account with us.
• Material: For the purposes of these Terms, “material” shall mean any names, photos, video, text, graphics, sound material, published on the Website or App, whether a copyright of Oggangs, its owner/director, its licensors or other users or any third party. You are not allowed to download or print the material, or extracts from it, in a systematic or regular manner or otherwise so as to create a database in electronic or paper form comprising all or part of the material appearing on the Website or App. You must not reproduce any part of the Website or App or the material or transmit it to or store it in any other website or disseminate any part of the material in any other form, unless we have indicated that you may do so.

 

Restricted uses:

• You cannot use the Site or App for any illegal or prohibited or restricted purposes, or for committing any fraudulent act, or any other act that is deemed to be unlawful as per the laws of Republic of India. 
• You can’t impersonate others or provide inaccurate information. 
• You must not misuse or interfere with the Website or App or try to access them using a method other than the interface and the instructions that we provide. You may use the Services only as permitted by applicable law, and as per the directions provided by us. 
• You should neither conduct nor assist the usage of cheats, exploits, automation, software, bots, hacks or any unauthorized third-party software specifically formulated for modifying or intervening with our Platform.
• You must not be copying, modifying the technology and software associated with Oggangs. Further, you hereby accept not to rent, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to anyone of the associated technologies and software.
• You must neither modify nor become a cause of modification of any of the files, technology or software associated with Oggangs;
• You must not disrupt, overburden, or promote any kind of disruption or overburdening to the servers or computers offering or supporting our Services or the enjoyment of our Services by other users.
• You shall neither support or conduct any sort of attack including (but not limited to) distribution of a virus or computer contaminants which may interrupt, destroy, limit the functionality or disrupt any software, hardware or other equipment belonging to us or that aids in providing the Services offered by Oggangs or which shall restrict the use or enjoyment of other Oggangs users.
• Any form of fraudulent activity including, attempting to use or using any other person’s credit card(s), debit cards, net-banking usernames, passwords, authorization codes, prepaid cash cards, mobile phones for adding cash to your user account is strictly prohibited.
• Winnings, bonuses, vouchers and prizes are unique to the player and are non-transferable. In the event you attempt to transfer any winnings, bonuses, vouchers or prizes, these will be forfeited.
• You shall not use the Services on the Platform for commercial purposes.
• You must not engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory or abusive action or communication on our Platform.
• You must not harass, stalk, threaten, or otherwise violate any legal rights of other individuals on our Platform.
• You must not advertise, offer or sell any goods or services for any commercial purpose on our Platform without our express written consent; and
• You must not transmit content regarding services, products, surveys, contests, events, pyramid schemes, spam, unsolicited advertising or promotional materials, or chain letters.

You must not:

• republish material from the Website or App;
• sell, rent or sub-license material from the Website or App;
• show any material from the Website or App in public without our consent;
• edit or otherwise modify any material on the Website or App (other than editing your own information as per the method provided);
• reproduce, duplicate, copy or otherwise exploit material on our Website or App for a commercial purpose; or

redistribute material from the Website or App, except for content specifically and expressly made available for redistribution, or with our written consent and according to our terms;

infringe or violate our Intellectual Property Rights or Intellectual Property Rights of our licensors or other users or any third party;

• We reserve the right to restrict your access to any areas of our Website or App, or indeed our whole Website or App, at our discretion.
• We reserve the right to discontinue our services, or discontinue any of the App features, at any time, at our sole discretion.
• You must not use our Website or App in any way that causes, or may cause, damage to the Website or App or impairment of the availability or accessibility of the Website or App; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
• You must not use our Website or App to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
• You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our Website or App, without our express written consent.

 

WINNINGS AND PAYOUTS

• Rewards for all Contests will be clearly stated during registration and detailed in the specific rules for each Contest. Prizes may encompass Sapphires,Ruby,&nbsp or promotional items.
• Users are permitted to withdraw, under conditions, their Winnings from their Account to their validated bank or wallet account, contingent upon successful KYC (Know Your Customer) verification.
• It is imperative that your bank account / UPI ID remains active to facilitate seamless withdrawals; and
• When opting for withdrawal through a bank account or UPI, it is crucial to ensure that the name on your KYC document aligns with the account holder's name provided for the purpose of Winnings withdrawal. In case of any discrepancy, please retry inputting your bank account details / UPI ID to ensure synchronization with your KYC document.
• KYC validation is a prerequisite to establish your identity for initiating Winnings withdrawal to your bank or wallet account. KYC verification can be completed on the Platform by submitting: (i) a photograph of a valid government ID (such as Aadhaar Card, PAN Card, etc.); and (ii) other pertinent User Details.
• If you decide to employ your Aadhar card / Number for KYC compliance, you hereby affirm: (i) That your Aadhar information is exclusively utilized for KYC validation; and (ii) You grant us temporary access to your Aadhar card, with full understanding that we will not retain your Aadharnumber beyond legal requirements.
• OGGangs does not generate receipts for Contest entries. Entries are meticulously logged within your Account on the Platform. Users assume responsibility to verify the accuracy of entries and ensure appropriate crediting of Winnings to their Account

 

REPRESENTATION AND WARRANTIES BY USER

You hereby are making the following representation and warranties to Oggangs, that:

• You hereby represent that you are at least 18 years of age or older to use the Platform, and are also otherwise entitled to enter into contracts as per the requirements of Contracts Act, 1872. You are aware that participation in the sports or games or events(s) organized by us, hereinafter referred to as “Activity” may result in financial loss to you. With full knowledge of the facts and circumstances surrounding this Activity, you are voluntarily participating in the Activity and assume all responsibility and risk resulting from your participation, including all risk of financial loss. You agree to indemnify and hold us, our employees, directors, officers, and agents harmless with respect to any and all claims and costs associated with your participation in the Activity.
• You represent that you have the necessary experience and the requisite skills and knowledge required to participate in the Activity and that you are not aware of any physical or mental condition that would impair your capability to fully participate in the Activity. You further acknowledge that you are solely responsible for any consequence resulting from you participating in this Activity or being associated with this Activity or around this Activity. You understand that we assume no liability or responsibility for any financial loss that you may sustain as a result of your participation in the Activity.
• You are not, and you will be not in possession of or access to any information irrespective of its means, relating to any player, event, game, or its securities, directly or indirectly which is not available in the general course with the public at large and upon being disseminated, such an information may have material effect on the stock price.
• You agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by us, through any means). You further agree to update and keep updated your registration information at all times.
• You will not register or operate more than one user account for accessing the Platform.
• You hereby acknowledge that the Company, in its sole and absolute discretion may require you to generate a One Time Password (hereinafter referred to as “OTP”) and to fill in and submit the same so as to log in to your user account or in order to get access to the Platform and its Services.
• You shall continue to be logged into the App till the time you voluntarily exit/or logout of your account, or by the actions of Company as it may deem fit in its sole and absolute discretion. You agree to exit/log-out of their accounts at the end of each session. The Company shall not be responsible for any loss or damage that may result if you fail to comply with these requirements.
• Any password generated or issued by Oggangs to you shall not be revealed to anyone else. You shall not use anyone else’s password. You are solely responsible for maintaining the confidentiality of your account and password, and agree to immediately notify the Company of any unauthorized use of your password or account or any other breach of security.
• You hereby agree to ensure that you can receive all communication from the Company by marking e-mails or sending SMSs from the Company as part of their “safe senders” list. The Company shall not be held liable if any e-mail/SMS remains unread by you as a result of such e-mail getting delivered to your junk or spam folder.
• Prior to adding cash to your user account or participating in event(s), the responsibility to satisfy the legality of such event(s) in the jurisdiction from where you are accessing the event(s) shall be on you. If you are not legally competent to individually enter into Indian Rupee transactions through banking channels in India and/or are not accessing any Platform from a permitted jurisdiction, you are prohibited from participating in event(s) on the Platform. In the event of such violation, your participation in event(s) will be deemed to be in breach of the Terms and you will not be entitled to receive any prize that you might win in such event(s), nor shall you be entitled to get a refund for your Ruby and Sapphire.
• You understand and accept that your participation in an event available on the Platform does not create any obligation on us to give you any winnings or vouchers or rewards. Your winnings are entirely dependent on your skill as a player vis-a-vis other players in the event or game and subject to the rules of the event or game.
• You understand that the funds in your user account held by us do not carry any interest or return, and cannot be exchanged for money, or withdrawn into your bank account. You can only convert your ruby or sapphire into rewards and vouchers (if available on the app). 
• You shall not hold us responsible for not being able to play any event(s) or game(s) for which you may be eligible to participate. This includes but is not limited to situations where you are unable to log into your user account as your user account may be pending validation or you may be suspected or established violation of any of the Terms.
• You will comply with all the applicable laws, rules, notifications and court order/decrees concerning your participation in the events and games on our Platform. 

 

PUBLICITY

Acceptance of a winning by the winner constitutes permission for Oggangs, and its affiliates to use the winner’s name, likeness, and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any further permissions or consents and/or additional compensation whatsoever. The winners further undertakes that they will be available for promotional purposes as planned and desired by Oggangs without any charge. 

 

OUR CONTENT AND RIGHTS

This Site, App, website, its logos, its content, events, advertisement, photographs, designs, trademarks, trade dress, trade name, player names, flash animation, all of our technologies, features, functionalities and services, shall remain the sole property of the Oggangs, and/or its licensors, as the case may be. Your use of or access to this App or Site or availing of our services shall not in any way transfer or assign to you any ownership or other proprietary rights in or to this App, our services including OGShorts, any content (except your own content), designs, published by us or our licensors or third parties. This App/Site and the content, including but not limited to the trademark, logo, copyright, design, layout, typography, underlying HTML, Java scripts, text, audio clips, video clips and graphics, and in the expression of the information contained herein, whether as a compilation or otherwise is protected by relevant Intellectual Property laws, rules and regulations. Trademarks, trade names and designs appearing on this App or Site are the exclusive property of, or are licensed to the Oggangs and are protected. You are granted a personal, non-exclusive, non-assignable and non-transferrable license to use the above-mentioned content solely for the purposes of accessing and using the Services and for no other purposes whatsoever. No use of a trademark, trade dress, trade name or design appearing on this App may be made without the prior written permission of the Oggangs or respective owner.

 

YOUR CONTENT AND OUR LICENSE

You understand and agree that you are solely responsible for all content posted, transmitted, uploaded or otherwise made available on the Platform by you. All content posted by you must be legally owned by or licensed to you. By publishing any content on the Platform, you agree to grant us a royalty-free, world-wide, non-exclusive, perpetual and assignable right to use, copy, reproduce, modify, adapt, publish, edit, translate, create derivative works from, transmit, distribute, publicly display, and publicly perform your content and to use such content in any related marketing materials produced by us or our affiliates. Such content may include, without limitation, your name, username, location, messages, gender or pictures. You also understand that you do not obtain any rights, legal or equitable, in any material incorporating your content. You further agree and acknowledge that we have the royalty-free right to use in any manner whatsoever, all communication or feedback provided by you, without any compensation to you in any manner whatsoever. The consideration for this license is the grant of our Services to you.

INVITE FRIENDS

The Oggangs Invite Friends Program (hereinafter referred to as “Referral Program”) lets the users to refer our Services and invite other individuals or friends (hereinafter referred to as “Referred User”) to join the Oggangs Platform in order to avail the Services. In the event that the user and the Referred User meet the criteria and complete all the steps specified in these terms, such User and the Referred User can earn a Bonus from the Company of up to 250 Ruby (hereinafter referred to as “Bonus Ruby”), which will be redeemable to join the events through the App.

• In order to participate in the Program, please note that the User’s participation in the Program will be governed by these Terms. 
• Eligibility of User for Program – The following users are eligible, who:
(i) have an account registered with and at Oggangs which account has been verified by the Company; and
(ii) are eligible to participate in the events(s) of the Company as per these Terms; and have downloaded and installed the App on their respective mobile devices, will be eligible to participate in the Program.
• A User shall not register or operate more than one user account with Oggangsand shall not participate in the Program with more than one user account.
• The program’s opening and closing date will be announced on the App (in there is any change). Through the App, the User will be provided with a unique link or code, which can be shared by the User (hereinafter referred to as “Inviter”) with Referred User (hereinafter referred to as “Invitee”) for the purpose of to create and register an account with and on App. On receiving the link or code from the Inviter, the Invitee may either: (i) Click on the link, consequent to which such Invitee will be directed to download and install the App on his/her device and register a User account on the App; or (ii) download and install the App on his/her device independently, register for a User account through the App and enter the unique code shared by the Inviter where prompted in the App.
• The Inviter and the Invitee will be eligible to earn the Bonus Ruby subject to (amongst other terms specified in these Terms):
• the Invitee not being an existing user of Oggangs; and
• the Inviter and Invitee being eligible to participate in the events(s); and
• the Invitee successfully registering for an account through the unique link or by using the unique code shared by the Inviter; and
• the Inviter and Invitee agreeing to the license agreement for the App and downloading and installing the App as available for the Inviter’s and Invitee’s respective mobile devices; and
• the Inviter and Invitee verifying the Inviter’s and the Invitee’s respective mobile number as provided at the time of registration within thirty (30) days from the date on which Invitee registers for an account with the Oggangs (hereinafter referred to as “Verification Period”). For the purposes of these Terms, an ‘existing user of Oggangs’ shall mean a user who presently operates an account with the Platform or operated an account with the Platform at any point of time.
• An Invitee who is an existing user of the Oggangs is not permitted to register a new account with the Oggangs for the purpose of availing of the Bonus Ruby or Sapphire. The Company, in its sole discretion will determine as to whether an Invitee is an existing user of Oggangs or not and take appropriate action.
• The verification process may require an Inviter/Invitee to submit personal information about the user (Inviter/Invitee) and documents identifying the Inviter/Invitee. The Inviter agrees to receive communication from the Company and to allow the Company to communicate with Invitees referred by such Inviter about the Invitee’s participation in the Program. Any information collected in respect of the Inviter/Invitee as part of the Program or otherwise in the course of such person’s use of the Platform shall be subject to our Privacy Policy.
• The Invitee will be eligible to earn a Bonus of 250 Ruby (hereinafter referred to as “Referral Bonus”) upon successful verification of the Invitee’s mobile number. Provided that the Invitee completes the verification within the Verification Period, the applicable Invitee Bonus shall be credited to the Invitee’s Wallet Account with the Oggangs, within fifteen (15) days of completion of successful verification of the Invitee’s mobile number. In the event that the Invitee fails to verify the Invitee’s mobile number within the Verification Period or omits to provide documents requested for such verification, the Invitee shall not receive the applicable Invitee Bonus specified above due to the Invitee for completing such verification process.
• In order for an Inviter to be eligible to earn the Bonus Ruby due to him/her (hereinafter referred to as “Inviter Bonus”), the Inviter must also download and install the App on his/her mobile device and verify his/her mobile number and email address prior to the completion of the Verification Period.
• The credit of the Inviter Bonus is contingent on the Invitee’s participation in Events(s) on the Oggangs. The Inviters bonus is subject to a maximum of 250 Ruby.
• Mere participation in the Program does not entitle the Inviter/Invitee to receive any Bonus Ruby or Sapphire. The Company may, at its sole and absolute discretion, disqualify any Inviter/Invitee if such Inviter/Invitee engages in or it is found that such Inviter/Invitee has engaged in any illegal, unlawful or improper conduct (with regard to the Program or otherwise). The decision of the Company will be final and binding with regard to the Program, and the deposit of the Bonus Ruby and no correspondence, objection, complaints, etc. will be entertained in this regard.
• This Program cannot be clubbed with any other events(s)/promotions/programs that are running simultaneously and organized or conducted by the Company. The Company reserves the right to change/modify/or withdraw the Program and/or change these terms and conditions without any prior notice of the same at its sole discretion.

OGGANGS “COMMUNITY CHAT-FEATURE”

• The Company introduces a feature known as the "Community Chat Feature", fostering connections between individual Users within the Platform. By engaging with this interactive tool, you have the liberty to enhance your experience by selecting a preferred image or employing creative visuals to shape your social profile (avatars). You have the freedom to opt for a unique identifier for your profile. Furthermore, you can decide whether to set your profile as accessible to the public, allowing any registered User(s) on our Platform to discover it, or choose to make it private.
• By consenting to these terms, you grant us continuous permissions and all requisite licenses necessary to offer the social interactive features on our Platform. It is important to note that we do not assert ownership over your content. As part of these broad permissions, you expressly authorize us to gather, depict, utilize, replicate, adapt, modify, merge, present in public view, generate derivative works from, and integrate such content into other creations. We reserve the right to utilize your data in ways we deem suitable. Kindly understand that the Company serves as a platform for providing skill-based games to our Users.
• On occasion, we may circulate survey questions or polls to gain insights into your experiences with the "Community Chat Feature." Your participation in these surveys and polls is entirely voluntary, and we assure you that we will not disclose the amalgamated responses from these surveys and polls to the public.
• The services we deliver on our Platform are presented "as is," and you bear exclusive responsibility for your actions within our Platform. The Company shall not be held liable for your actions, behavior, or any content (including potentially unlawful or objectionable content) uploaded by you onto our Platform. We reserve the prerogative to remove any content uploaded by you, such as profile pictures or names, or even your entire profile, should any inappropriate content or activity be identified, with or without prior communication to you.
• We strongly advise against utilizing anyone's intellectual property without obtaining proper authorization. The Company disclaims any responsibility, liability, or accountability in any form for any infringement of intellectual property, rights related to personal identity, moral rights, or any other claims that may arise from the content uploaded by any User.
• These terms constitute an integral facet of our agreement, and your acceptance of these terms is vital for your continued use of our Platform and participation in the "Community Chat Feature."

 

• OGGANGS SHORTS

 

Our platform offers users the ability to create and share short video clips known as "OGShorts." As part of this feature, we collect and process certain information to facilitate the creation, sharing, and interaction with OG Shorts. Protecting your privacy is of utmost importance to us, and we are committed to transparently outlining how your data is used in relation to OGShorts.

 

• User-Generated Content:

When you create OGShorts on our platform, you may upload, record, or share content, including videos, audio, text, and other media. This user-generated content may be viewable by other users according to your privacy settings and the visibility options you choose.

• Information We Collect: 

OGShorts Content: We collect the content of the OGShorts you create, upload, or share, including videos, captions, audio, and other related media.

• Data Collection and Usage: 

We collect associated metadata, such as the time of creation, date, and location if you choose to enable location services.

• Engagement Data: 

We gather information about how users interact with your OGShorts, such as the number of views, likes, comments, and shares.

• Sharing and Visibility:

You have control over the visibility and sharing settings of your OGShorts. You can adjust these settings to determine who can view and interact with your content, including making OGShorts public, visible to specific groups, or restricted to private viewing.

• User Consent:

By creating and sharing OGShorts on our platform, you grant us the necessary permissions to process and display your content according to your chosen privacy settings. You also acknowledge that other users may engage with and interact with your OGShorts as per the features and functionalities of the platform.

• Retention and Usage:

We retain your OGShorts content and associated data in accordance with our data retention policies. This allows you and other users to continue interacting with the content over time.

• Data Security:

You alone, though, remain responsible for the content you create, upload, post, send, or store through the Service.

 

• Third-Party Sharing:

We do not share your OGShorts content with third parties for marketing purposes without your explicit consent. However, please note that any OGShort shared publicly may be accessed by other users of the platform and, in some cases, may be discoverable by search engines.

By using the OGShorts feature on our platform, you acknowledge and agree to the collection, processing, and sharing of your data as described in this clause. ONLY GAMES THAT REQUIRE SKILL WILL BE PERMITTED ON THE PLATFORM:

Users acknowledge that the Games available on the Platform are based on skill, as defined by Indian law. The Platform does not endorse or support games of chance. Games of skill are those in which a player's effort and skill significantly influence the outcome, more so than luck.

The Games hosted on the Platform are classified as games of skill because success is directly tied to a User's effort, performance, and skill. The Supreme Court of India recognizes the right to engage in games of skill as constitutionally protected.

Restricted Territory: The Platform is not accessible in Andhra Pradesh, Arunachal Pradesh, Assam, Meghalaya, Nagaland, Odisha, Telangana, Sikkim, Tamil Nadu, or beyond the borders of India.

In accordance with prevailing laws, individuals residing in the Indian states of Andhra Pradesh, Arunachal Pradesh, Assam, Meghalaya, Nagaland, Odisha, Telangana, Sikkim, Tamil Nadu, and outside India are not eligible to participate in paid versions of the Game(s). Access to the Platform will be restricted for Users from these states. However, the free-to-play versions of our Game(s) will remain accessible in these territories.

Users from the aforementioned states or outside India are prohibited from playing with real money or depositing funds for Games on the Platform. User location verification may involve tracking IP addresses and geographical locations. The Company reserves the right to terminate such Accounts at its discretion, without prior notice.

Users acknowledge that any breach of state laws is the sole responsibility of the User, and the Company will not be liable. Penalties imposed by State Governments or the Central Government of India, if applicable, are the responsibility of the Users.

Users from all Indian states are responsible for ensuring compliance with applicable state laws. We will strive to communicate any relevant changes for User education. Decisions made by the Company in this regard are final and binding, without exceptions.


RESERVATION OF RIGHTS

Oggangs hereby reserves all of the following rights, to:

• Restrict, suspend, or terminate your access (either partial or complete) to all or any part of the Platform and/or our Services, in cases where you have violated: i) any provision of these Terms, ii) any applicable law, direction, court order/decree or government notification, and iii) any additional terms as applicable to a particular event or game that you participate in, or in the cases where you have posted untrue or defamatory statement anywhere on the internet about Oggangs;
• Change, suspend, or discontinue all or any part of the Platform and/or our Services;
• Reject, move, or remove any material that may be submitted by you, for any reason or no reason, at our sole discretion;
• Move or remove any content that is available on our Site or App;
• Deactivate or delete your account and all related information and files on the respective account;
• Offer discounts to you in form or forms that we deem fit (“Bonus”). All such discounts shall be credited in a separate account called as Oggangs Wallet Account;
• Revise or make additions and/or deletions to the roster of seats available for participation in a event on account of revisions to the roster of seats listed at a particular event or game;
• Assign its rights and liabilities to all user accounts hereunder to any entity (post such assignment intimation of such assignment shall be sent to all user’s to their registered email ids).
• Transfer of any amount appearing to the credit of the user’s Winning Account or the Oggangs Wallet Account in the event of deactivation or deletion of the User’s Account with the Company shall be at sole and absolute discretion of the Company and the same shall be uncontestable before any Court of Law or Authority (unless provided otherwise as per any applicable law).
• If it comes to the notice of Oggangs that any governmental, statutory or regulatory compliances or approvals are required for conducting any events(s) or if it comes to the notice of Oggangs that conduct of any such events(s) is prohibited, then Oggangs shall withdraw and / or cancel such events(s) without prior notice to any participants or winners of any events(s). Users agree not to make any claim in respect of such cancellation or withdrawal of the event or event it in any manner.

• The Platform or the Services might contain links to third-party websites, products and services. For example, third party payment gateway service providers or our partners where you can use the vouchers. Such third-party links or partners are not under the control of Oggangs, and Oggangsis not responsible for any third-party links or partners. Oggangs provides access to these third-party links or partners only as a convenience to you, and does not review, approve, monitor, endorse, warrant, or make any representations with respect to third-party links. You shall use all third-party links at your own risk, and should apply a suitable level of caution and discretion in doing so. Whenever you click on such links, you are taken to such third-party website, and you get out of the jurisdiction of our Website or App. Therefore, you shall be governed by the terms & conditions, privacy policy and other policies of such third-party websites and we suggest that you read those policies. 
• Making an in-app purchase may require you to share additional personal identification and/or payment related information with us. If any private information that is collected by a third-party billing service during purchases, it is stored and secured by that third party and may or may not be shared with us. The third party has the liability for storing and securing the additional information. If any particular information is provided to OGGangs, we can only ensure protection of such additional information. If any particular information is provided to OgGangs, we can only ensure the protection of such information on our portal. Payment failure and refund related queries need to be addressed by the third party as per their own T&Cs.

NO REFUNDS

Notwithstanding anything to the contrary set forth herein (but subject to any applicable law), the purchase of Sapphire shall be non-refundable, and your entry in a particular game or event shall not be entitled to be cancelled or revoked. You must read the rules of the game or event in advance before participation. You cannot withdraw your sapphire or winnings, and are only entitled to win vouchers and rewards, as per event or app rules.

 

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, we DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FINANCIAL GAIN OR LEGALITY OR FITNESS FOR A PARTICULAR PURPOSE, TITLE, ANDNON-INFRINGEMENT about our services, games and events. In no event shall Oggangs, or its owner(s), be liable to you or any third party for any lost profits, lost time, lost data, financial loss, costs of procurement of substitute services, or any indirect, consequential, exemplary, incidental, special or punitive damages arising from or relating to these terms or our services, even if Oggangs has been advised of the possibility of such damages. Access to, and use of, the App and Site and availing our services is at your own discretion and risk, and you will be solely responsible for any losses or damages resulting therefrom. In case of any technical failures, server crashes, breakdowns, software defects, disruption or malfunction of service, as a policy, Oggangs will cancel the event(s) and refund the amounts as Ruby or Sapphire after proper verification and you accept that Oggangs is not responsible to you in all such cases. Oggangs is also not liable for any prospective winnings from any incomplete tournament/game/event. It is clarified that, notwithstanding any limitation of liability as specified herein.

 

LEGAL ACTION

If you are found to be degrading, tarnishing, maligning the image, goodwill or reputation of Oggangsor its owners/directors, by spreading hate, insulting, false, fake reviews or engaging in mala fide actions against the above, strong legal actions will be taken immediately. We can also suspend or terminate your account in such cases, at our sole discretion.

 

INDEMNITY

You acknowledge to defend, indemnify and hold Oggangs, its owners/directors, and licensors (hereinafter referred to as “Indemnified Party”) harmless from and against any claim, disputes, fine, liability, demand or expense, including reasonable Lawyer’s fees, made by a third party, relating to, or arising from:

• Your violation of our rights or rights of other users, including without limitation to any right to privacy, publicity rights, defamation or intellectual property rights;
• Your wrongful or improper use of our services, Site or App or events or games;
• Your violation of any applicable laws, rules or regulations;
• Your violation of these Terms or any other policy of ours as associated with our services;
• The indemnifications set forth above will survive the termination or expiration of these Terms and/or your use of our services.

 

GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law: The Terms and any dispute arising from the same will be governed by applicable laws of Republic of India. 

Exclusive Jurisdiction: All disputes must first be attempted to resolved amicably, failing which, such controversy, conflict or dispute shall be finally settled by bringing it before the appropriate courts situated in Bangalore, Karnatakan, and/or Bangalore High Court.

 

COPYRIGHT INFRINGEMENT

You are required to follow the below procedure to file a claim:

• Provide your physical and/or electronic signature;

• You may be subject to liability if you knowingly make any misrepresentations on a take-down notice or claim.

• Breach: In case of any breach or threatened breach to the provisions of these Terms, we reserve the right to suspend your account, and your access to our website or App, at our sole discretion. In such case, your Ruby, Sapphire and winnings might be forfeited at the Company’s discretion, and you will not be entitled to a refund of any sort.
• Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions of these Terms will continue in full force and effect.
• Waiver: Our failure to insist on or enforce strict performance of these Terms & Conditions shall not be construed as a waiver by us of any provision or any right that we have to enforce these Terms and nor shall any course of conduct between us and you or any other party be deemed to modify any provision of these Terms.

• Entire Agreement: The Terms, Disclaimer, and our Privacy Policy, together with any additional terms and conditions of a particular event or game, constitute the entire Agreement between Oggangs and you, relating to the subject matter hereof, and supersedes any prior understanding or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on our Website or App.
• Force Majeure: Oggangs, its owner/director, and its agents will be excused from performance for any period during which, and to the extent that, such party or any subcontractor is prevented from performing any obligation or service, in whole or in part, as a result of causes beyond its reasonable control, and without its fault or negligence, including without limitation, acts of God, strikes, lockouts, riots, acts of terrorism or war, epidemics, communication line failures, power failures and government-imposed lockdowns or similar restrictions.
• Updates to these Terms: We may add to or change or update these Terms at any time, from time to time, entirely at our own discretion, with or without any prior written notice. You are responsible for checking these Terms periodically. Your use of the Site after any amendments to the Terms shall constitute your acceptance to such amendments.
